1. IntroductionWelcome to Fit4Me, a fitness web and mobile application designed to support your weight loss and fitness goals. By subscribing to our services, you agree to these Terms of Use (the “Terms”). These Terms are intended to be governed by applicable consumer laws and regulations, ensuring fairness and transparency in our transactions.
These Terms apply to your access and use of our mobile application Fit4Me and our website(s) or related pages, including
www.adaptivewellness.site, which are operated and provided by ADAPTIVE WELLNESS SOLUTIONS LTD (Castle St, Apt C30 Castle Park View Block A, BS2 0ND, Bristol, United Kingdom, company number 17151437) (“Operator”, “we”, “us”, or “our”).
For clarity, Nutrionika LLC (3003 Tamiami Trl N, 3rd floor, Naples, Florida 34103, USA) is the owner of the Fit4Me intellectual property and related trademarks (“IP Owner”). The Operator provides the Fit4Me application and website to end users under a reseller/license agreement with the IP Owner.

https://us.fit4me.io (including any applicable country- or product-specific terms) may also apply to your use of the Services. If there is a conflict between those terms and these Terms, the terms on
https://us.fit4me.io will prevail to the extent of the conflict for the relevant product, website, or service.
Your access to and use of Fit4Me is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the application. By accessing or using Fit4Me, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not access or use the application.
2. PaymentsTo provide the subscription and one-time purchases, we use payment processors and payment service providers (“PSPs”) and, where applicable, app-store billing (Apple App Store / Google Play).
By making a purchase, you authorize us (and our PSPs) to charge your payment method for the amount shown at checkout, including applicable taxes and fees (if any).
For subscriptions, you authorize recurring charges at the frequency and price disclosed at the time of purchase, unless you cancel in accordance with these Terms and/or the applicable app-store rules.
You agree that we and our PSPs may take reasonable steps to:
- verify your identity and payment method, and perform fraud-prevention checks;
- screen transactions to comply with applicable laws and network rules (e.g., anti-fraud, sanctions compliance, and anti-money laundering requirements where applicable);
- request additional information or suspend/decline a transaction if required to manage risk or comply with law or PSP requirements.
You must not use the Services for any unlawful, fraudulent, or abusive purpose. We may restrict access, suspend accounts, or refuse payments where we reasonably believe it is necessary to protect users, comply with legal obligations, or meet PSP requirements.
We may change or add PSPs or payment methods from time to time. Where required by law, we will give you notice of material changes.
2.1 Authorized use of paymentsYou may only use payment methods that you are authorized to use. You must provide accurate billing and contact information and keep it up to date.
2.2 Prohibited payment-related activityYou must not (and must not attempt to): (i) bypass security or risk controls; (ii) manipulate, conceal, or misrepresent transaction information; (iii) use the Services in connection with fraud, money laundering, terrorist financing, or sanctioned persons; or (iv) use the Services in a manner that violates card network rules, app-store rules, or PSP requirements.
3. Subscription and Payment TermsFit4Me offers subscription plans on a monthly, and quarterly basis. By subscribing, you authorize us to charge the applicable subscription fee to your selected payment method at the start of each billing cycle. Subscriptions automatically renew unless canceled before the next billing period.
- Billing Cycle: Payments are processed at the beginning of each subscription period.
- Automatic Renewal: Your subscription will renew automatically unless canceled before the renewal date.
- Cancellation Policy: You may cancel your subscription at any time, but payments already processed are non-refundable.
- Trial Periods and Promotions: Cancel before the trial period ends to avoid charges.
If you subscribe via the Apple App Store or Google Play, billing, cancellation, and refunds are handled by the relevant app store and are subject to that store’s terms. Where required by law, you may have additional consumer rights that cannot be excluded.
3.1 Subscription Cancellation TimingTo avoid being charged for the next subscription period, you must cancel your subscription at least 24 hours before the renewal date. Cancellations can be done directly through your account settings in the application or through the platform used to subscribe (e.g., App Store or Google Play, website).
If you cancel less than 24 hours before the end of your current billing period, the cancellation will take effect from the next billing cycle, and you will retain access to premium features until the end of the current period.
3.2 Changes in Payment Terms and Additional OffersWe may occasionally update the terms of your subscription, including pricing, billing intervals, or service availability. Any material changes will be communicated to you in advance via the email associated with your account or through in-app notifications.
From time to time, we may offer optional additional services, features, or digital content for a separate fee (“upsell offers”). These purchases are entirely voluntary and are clearly presented before payment is completed.
One such optional upsell is the Pack 5-in-1, which is a one-time purchase and includes access to digital content and services such as: fasting-related features, digital guides, premium support.
The Pack 5-in-1 is a digital product provided immediately after purchase and does not qualify for a right of withdrawal or refund.
By completing the purchase, you expressly agree to the immediate delivery of the digital content and acknowledge that you lose any right to cancel or request a refund once access is granted.
3.3 Chargebacks and payment disputesIf you believe a charge is incorrect, please contact us first at support@fit4me.io so we can investigate and, where appropriate, resolve the issue. Unfounded chargebacks may result in suspension of your account and loss of access to premium features.
We may share information and evidence about a transaction with our PSPs and relevant payment networks to respond to chargebacks and prevent fraud.
We may also report suspected fraudulent activity to PSPs and, where appropriate, to relevant authorities.
4. Refund PolicyWe do not generally provide refunds for subscription payments. However, where applicable law (including US consumer protection laws, where applicable) requires a refund or provides a non-waivable right, we will comply. Requests for refunds will be reviewed on a case-by-case basis. More information about the Return Policy can be found here.
If you made your purchase through the Apple App Store or Google Play, refund requests must be submitted through the relevant app store, except where applicable law requires otherwise.
5. Dispute Resolution by Negotiation and Binding Arbitration AgreementIn the event of a dispute, we encourage you to contact our customer support team first to seek an amicable resolution. If the dispute cannot be resolved through direct negotiations, both parties agree to resolve the matter through binding arbitration per US arbitration laws. This means that any disputes will be settled by an independent arbitrator rather than through court proceedings.
5.1 Where arbitration may not applySome jurisdictions do not allow mandatory arbitration or limitations on certain rights. Where applicable law does not permit arbitration for a particular type of dispute, this arbitration section will not apply to that dispute.
6. Important DisclaimersFit4Me is not a medical device and does not provide any medical advice.Fit4Me only provides tools to support your wellness goals and help you live a healthier life. We do not make any guarantees regarding the effectiveness of our Services, and you use them at your own risk.
Fit4Me is not a substitute for professional medical advice, diagnosis, or treatment. You should consult a doctor or other qualified healthcare provider if you have any concerns about your health or before making any significant changes to your diet or exercise routine.
By using Fit4Me, you acknowledge that any reliance on information provided by the application is at your own risk. We do not accept liability for any injury, illness, or other consequences resulting from your use of Fit4Me.
7. Account SecurityYou should take all necessary actions to prevent others from accessing your account and your information. If someone has gained access to your account, inform us at support@fit4me.io, and we can help you deactivate your account.
8. Enforcement rightsWe are not obliged to monitor your access or use of the Services, however, we reserve the right to do so for purposes of operating and maintaining the Services, ensuring your compliance with the Terms, and complying with applicable legal requirements.
We may refuse service, close accounts, and change eligibility requirements at any time.
Fit4Me has no liability or responsibility to users of our Services or any other person or entity for the performance or nonperformance of any of the above.
9. Eligibility and acceptable useYou must be at least 18 years old (or the age of majority where you live) to make purchases. You agree not to use the Services to engage in illegal activity, violate the rights of others, or interfere with or disrupt the Services.
10. Compliance with laws; export; sanctionsYou must comply with all applicable laws when using the Services. You represent that you are not located in a country or region subject to comprehensive sanctions and that you are not a person or entity with whom we are prohibited from doing business under applicable sanctions laws.
11. AmendmentsFit4Me reserves the right to amend these Terms at any time. Updates will be published on our website, and continued use of the Services implies acceptance of the revised Terms.
12. Intellectual PropertyFit4Me and its original content, features, and functionality are and will remain the exclusive property of Nutrionika LLC and its licensors, including ADAPTIVE WELLNESS SOLUTIONS LTD.
13. Governing lawTo the extent permitted by applicable law, these Terms (and any dispute arising out of or related to the Services) are governed by the laws of England and Wales, without regard to conflict of law rules. Where mandatory consumer laws in your jurisdiction apply, those mandatory provisions will prevail.
